Awerco Construction Limited has threatened legal action against Ghana’s Ministry of Health, demanding an immediate retraction of what it describes as “inaccurate and misleading” claims linking the company to delays in operationalising the Weija-Gbawe Children’s Hospital.
In a letter dated May 8, lawyers for the contractor accused the ministry of damaging the firm’s reputation through a May 5 press statement titled “Operationalisation of the Weija Paediatric Hospital.” The statement allegedly cited procurement irregularities, including claims that some medical equipment had been priced at up to 11 times their actual cost.
Awerco rejected the allegations as “unfounded,” insisting that no evidence had been presented to substantiate the claims.
“Our client has been wrongly portrayed as being responsible for the Ministry’s inability to commission and operationalise the Weija Paediatric Hospital,” the company’s lawyers said.
The contractor further stated that concerns reportedly attributed to the World Bank had never been communicated to the company, maintaining that it had fulfilled all contractual obligations under the project.
According to Awerco, it had made several attempts over the past year to engage the ministry over outstanding payments but received no response. The company said these delays had affected key processes, including mandatory end-user training required before the hospital could be formally handed over.
It also disputed suggestions that it had halted the commissioning of the facility, clarifying that it had only raised concerns about proper handover procedures and the installation of critical protective systems such as Uninterruptible Power Supply (UPS) units and Automatic Voltage Regulators.
The absence of such systems, the company warned, could damage sensitive medical equipment and compromise the hospital’s operations.
“Failure to undertake such training poses an additional risk to the project and to potential patients,” the letter added.
Awerco also questioned the ministry’s position, arguing that it was contradictory to proceed with operationalisation while alleging inflated procurement costs.
The company has given the ministry 24 hours to retract the contested portions of its statement or face legal action.
The Ministry of Health has not yet publicly responded to the latest development.
