Frank Davies denies bail hearing for Ken Ofori-Atta, says extradition filing still pending

A member of the legal team for former Finance Minister Ken Ofori-Atta has dismissed reports that a United States court recently heard and rejected a bail application for his client, insisting no such proceeding took place.

Speaking on Asaase Radio’s Big Bulletin on Wednesday (25 February), lawyer Frank Davies said claims that a Virginia court denied Ofori-Atta bail on medical grounds were inaccurate.

“There was no hearing on February 19. Listen to me — there was no hearing,” Davies said, adding that reports circulating in sections of the media and on social platforms misrepresented the court process.

According to him, the last appearance focused on the adjustment of Ofori-Atta’s immigration status. During that session, counsel for the United States Department of Justice opposed any bond or bail arrangement, citing an extradition request from Ghana.

Davies explained that the judge subsequently directed US authorities to formally assemble and file the extradition materials before the court. However, when the matter was expected to be heard on February 19, prosecutors only submitted what he described as a brief notice referencing an extradition request without disclosing substantive details.

Because of this, he said, the court postponed proceedings, with a hearing now anticipated in mid-March.

He criticised officials of the Office of the Special Prosecutor, accusing them of spreading misleading information about the case and failing to communicate accurately with the public.

Davies also addressed developments concerning an Interpol red notice previously issued against Ofori-Atta, confirming it had been deleted.

He said Interpol’s Commission for the Control of Files determined that the request breached its rules and appeared to be “of a predominantly political character,” leading to the removal of the alert and deletion of related data from its systems.

“The commission said there were no targets whatsoever against Ken,” Davies said, arguing that the decision weakens the basis for international enforcement actions tied to the case.

Ofori-Atta, who is facing legal and investigative scrutiny in Ghana, remains engaged in immigration-related proceedings in the United States while the extradition request is being considered.
