OSP prosecutions “dead” without AG authorisation — Kwame Adofo

Private legal practitioner Kwame Adofo has described ongoing prosecutions by the Office of the Special Prosecutor (OSP) as legally flawed, insisting they lack validity without authorisation from the Attorney-General.

Speaking on Asaase Breakfast Show, Adofo argued that the OSP’s enabling law, Act 959, clearly requires prosecutorial authority to be derived from the Attorney-General under Article 88 of the Constitution.

“You cannot take somebody to court unless authorised by the Attorney-General,” he said.

According to him, cases filed without such approval are fundamentally defective and must be withdrawn and refiled properly.

“The cases are dead. They have to be withdrawn and refiled by a competent authority,” he insisted.

Adofo maintained that the High Court ruling simply affirmed an already clear legal position and should not be considered controversial.
