High Court ruling on OSP powers consistent with Constitution — Ansa-Asare

A former Director of the Ghana School of Law, Kwaku Ansa-Asare, has defended the recent High Court ruling limiting the prosecutorial powers of the Office of the Special Prosecutor (OSP), describing it as consistent with Ghana’s constitutional framework.

Speaking on the Asaase Breakfast Show on Thursday (16 April), he argued that the decision aligns with Article 88 of the 1992 Constitution, which vests prosecutorial authority in the Attorney-General.

According to him, the legal position that the Attorney-General controls prosecutions dates back to colonial legal structures and remains firmly embedded in Ghana’s jurisprudence.

“The ruling is sound. It is consistent with Article 88. The OSP does not have unlimited prosecutorial powers,” he stated.

He dismissed claims that the High Court exceeded its jurisdiction, explaining that the court merely applied existing constitutional provisions rather than interpreting them.

Ansa-Asare stressed that the ruling should guide the conduct of the OSP moving forward unless overturned by the Supreme Court.
