Sir Sam Jonah cleared of criminal charges in Nigeria property dispute

The Attorney-General of the Federal Republic of Nigeria has ordered the termination of criminal proceedings against Ghanaian businessman Sir Samuel Edson Jonah and three others, after investigations found no prima facie case against them.

Sir Jonah, owner of Jonah Capital Nigeria Limited, along with the company’s Chief Executive Officer, Kojo Ansah Mensah, Victor Quainoo and Abu Arome, had been accused of forgery, fraud and related offences linked to a dispute over property at the River Park Estate in Lugbe, Abuja.

In a letter signed by the Director of Public Prosecutions, M. B. Abubakar, the Attorney-General, Prince Lateef Fagbemi SAN, said a review of police case files showed the allegations could not be sustained. The Attorney-General’s Office noted that police investigations failed to meet the required burden of proof and confirmed that no criminal liability had been established.

The Attorney-General also endorsed the findings of a Special Investigation Panel set up in March 2025, describing its report as valid and unbiased, while criticising attempts to criminalise what he described as a commercial dispute, contrary to Nigeria’s Administration of Criminal Justice Act.

He further raised concerns over a police press conference held on June 27, 2025, during which individuals were publicly presented as owners of the River Park Estate without a court ruling. The Attorney-General directed Nigeria’s Corporate Affairs Commission to reverse any administrative actions taken against the affected companies based on the disputed police report and cautioned against prejudicing ongoing court cases.

The Attorney-General also ordered fresh investigations into alleged criminal intimidation, assault and destruction of property at the River Park Estate and directed the police to ensure the safety of residents.

Sir Samuel Jonah had earlier petitioned Ghana’s Minister for Foreign Affairs and Regional Integration, Samuel Okudzeto Ablakwa, over the matter, prompting Ghana to raise the issue at the 95th ECOWAS Council of Ministers meeting in Abuja in December.

Meanwhile, Jonah Capital Nigeria Limited CEO, Kojo Ansah Mensah, has praised the Attorney-General for upholding the rule of law, saying the decision restores confidence among foreign investors.

He thanked the governments of Nigeria and Ghana and assured that Jonah Capital remains committed to investing in Nigeria, while cautioning investors to exercise care in dealings related to the River Park Estate, as the dispute remains before the courts.
