Effiduase/Asokore MP, Nana Ayew Afriye has filed an appeal against a High Court ruling that dismissed his defamation suit and awarded costs against him, according to court documents seen on Tuesday.
In a notice filed at the Court of Appeal in Kumasi, the legislator said he was dissatisfied with the March 26 judgment delivered by Poku Adusei and is seeking to overturn the decision in its entirety.
The appeal challenges the High Court’s findings that a defence of fair comment applied and that evidence supported claims he assaulted a former district chief executive during a 2019 political event.
It also contests the court’s position on the standard of proof required in establishing the alleged assault.
Afriye argues that the conclusions reached by the trial court were not supported by the evidence and resulted in a miscarriage of justice.
The case stems from remarks made by known political figure, Isaac Asante on Nhyira FM regarding an altercation during preparations for a presidential visit to Effiduase-Asokore, where a district chief executive was reportedly assaulted.
The High Court had earlier dismissed the suit, ruling that the defendant’s comments were substantially true and constituted fair comment on a matter of public interest. The court also awarded costs of 25,000 cedis against the plaintiff.
Afriye is now asking the appellate court to set aside that judgment as the legal battle moves to the next stage.
